Montana Revises University Sex Assault Investigation Policies

HAVRE, Mont. ? Montana?s university system moved forward Friday with a new policy for handling sexual assaults. The policy change follows a U.S. Justice Department investigation into the way the University of Montana responded to sexual assault and harassment reports.

The U.S. Justice Department investigation ?which began earlier this month ?prompted a second investigation by the U.S. Department of Education's Office of Civil Rights, the Associated Press reports. The university has come under fire in the past two years for mishandling rape cases, particularly those that involved football team members.

E-mails recently obtained by the press show that the University of Montana Vice President Jim Foley sought to punish a student for speaking publicly about how the university was handling her rape case.

The Board of Regents signed a new policy Friday aiming to ensure compliance with the Montana Human Rights Act, which prohibits discrimination on the basis of sex.

SAMENA Telecommunications Council seminar on building ...

SAMENA Telecommunications Council (SAMENA), a tri-regional industry association of leading telecommunications organizations, and European Telecommunications Network Operators? Association (ETNO) held the annual SAMENA Chairmen and CEOs seminar in Hong Kong under the theme ?Internet Policy Dynamics: Shaping the Future ? How consensus between The Policy Makers, Content Providers and Operators can lead us to Sustainable Digital Economies?. More than 65 chief executives and chairmen from leading telecom operators discussed and debated the importance of collaborative efforts in building sustainable Internet business models.

?

HKT, Hong Kong?s premier telecommunications service provider, and PCCW Global, an operating division of HKT which provides international connectivity to enterprises and service providers worldwide, were co-sponsors and hosts.

?

SAMENA and ENTO stressed that generating additional income is important for global telecom operators, considering flat revenues from traditional services, ever-increasing competition, very high CAPEX costs, and regulatory pressures. Telecom operators need to rethink their Internet business models in light of the recent trends which illustrate that Internet traffic has experienced exponential growth and is expected to continue in the foreseeable future.

?

SAMENA Telecommunications Council?s Content Committee has been exploring a number of possible future models that can assist operators to potentially offset the great imbalance between their CAPEX and ROI. The Council released a position paper on ?Perspectives on Meeting Massive Growth on Bandwidth Demands? to provide operators with a collective framework conducive to building a sustainable Internet business model jointly.

?

Mr. Sheikh Mohamed Isa Al Khalifa, Group CEO of Batelco and Chairman of SAMENA Telecommunications Council, said, ?The ICT ecosystem is very dynamic and the telecom operators should unite to address the changing elements in the industry, specifically in areas such as international telecommunications regulations (ITRs) as well as the building of the new sustainable Internet business model. The telecom operators are facing a critical point in the evaluation of requirements for additional CAPEX investment versus the potential realistic timely return on the same investment from broadband margins.?

?

Luigi Gambardella, Chairman of ETNO?s Executive Board, said, ?It is essential that both SAMENA and ETNO work together to encourage the development of policies that support investment in new infrastructure by stimulating the emergence of a new Internet eco-system that encourages commercial agreements on specific quality of service levels in order to meet customers? needs. Differentiated offers based on QoS would foster investment by telecoms operators while providing for a better user experience for Internet services.?

?

Mr. Alex Arena, Group Managing Director of HKT, said, ?Telecom service providers face commoditization in their core access businesses, and have therefore looked to content, applications, and other transactional services to find new revenue growth opportunities. Simultaneously, many content providers are seeking other means of distribution using OTT (?Over-The-Top?) Internet hoping to maximize their revenues.?

?

Mr. Arena added, ?The SAMENA Telecommunications Council is actively working towards the development of a viable framework which contemplates a number of forward looking collaborative business models to achieve a successful and mutually valuable working relationship among the parties. HKT is much honored to be hosting this year?s SAMENA Chairmen and CEOs Dinner in Hong Kong, bringing a significant number of key telecommunications executives from around the world to discuss and debate these framework proposals. HKT welcomes everyone to participate in the event while leveraging Hong Kong?s global ICT leadership position as a platform for new business.?

Police halt anti-GM wheat protest

Anti-GM protesters who had planned to "decontaminate" a field of modified wheat in Hertfordshire have been stopped from entering by a police line.

The Take the Flour Back group said it failed because the crop in Harpenden, created to deter aphids - a wheat pest - was "hidden behind a fortress".

An order banning protesters from entering the site was issued on Friday.

They say crops could contaminate the surrounding area. Site owner Rothamsted Research says that is highly unlikely.

Police say that two men, who were arrested for trespassing in the banned area, are being questioned at a Hertfordshire police station.

The protesters had planned to rip up the crops.

"In the past, kids, grannies, and everyone in between has decontaminated GM trial sites together," Take the Flour Back's Kate Bell said.

"Here at the beginning of a new resistance to this obsolete technology, we see GM hidden behind a fortress.

They were never going to get through.

The leaders of the action, Take the Flour Back, had acknowledged that in advance. The security presence was too overwhelming.

The march reached the police and got no further. Any dreams of reaching the plot of GM wheat were dashed so the protesters sat down and chanted "no GM" instead.

One woman protestor had adorned herself with the word "biodiversity" in body paint. A young man with a banner started up a siren but a police officer pointed out that this would alarm the horses so he agreed not to use it. It was that kind of event - no scuffles, no violence.

And the GM trial survived. The security plan triumphed. At least for today. The challenge will be to maintain this level of protection in the weeks and months ahead.

"We wanted to do the responsible thing and remove the threat of GM contamination - sadly it wasn't possible to do that effectively today."

The order, enforced by police officers around the perimeters of the site, banned protesters from entering the land as well as from walking on a public footpath that runs through it.

It was successfully granted to St Albans District Council after it was approved by the home secretary.

Take the Flour Back said 400 protesters - made up of "growers, bakers and families from across England, Ireland, Scotland, Wales, France and Belgium" - met at nearby Rothamsted Park at midday.

Police say there were up to 200 protesters.

Take the Flour Back said protesters then linked arms "and walked calmly towards the site before being stopped by police lines".

They sat down in front of officers for half an hour and shouted protest chants before returning to the park to continue their demonstration.

Despite the two arrests, police said there were "no disturbances in the area".

BBC correspondent Sophie Hutchinson said the protest at Rothamsted Park - policed by a few officers dotted around - had "the air of a festival" and featured music, singing and a number of speakers.

"We feel that GM presents potential risks," protester Tom Fenton told BBC News.

Protester Tom Fenton: "You can see the UK consumers don't want this."

"There's uncertainty about the health effect of this - there's been no adequate long-term health safety testing."

Rothamsted Research says GM is "just one tool in the toolbox to create more sustainable food".

But Mr Fenton said: "When the exploration of that tool compromises the existence for organic agriculture and compromise the existence of non-GM agriculture then it's just not fair to do so."

Opponents fear that, because the trial is taking place in the open air, the surrounding area could be contaminated.

Professor John Pickett, a principal investigator at Rochester Research, told BBC News there was "a very, very remote chance that anything should get out".

"All it would mean was that some other plant - if it ever did miraculously transfer into another plant - was making a smell like the aphid."

He said that, using genetic modification, the pheromone for the aphid had been put into the wheat to frighten aphids away.

Professor Morris Maloney says the protesters' claims are "scientifically inaccurate"

More importantly, the pheromone also attracted other insects to attack aphids, he said.

"It's crucially important, as we try to provide more food for the world, to protect our crops," he added.

The crop - developed with genes from the mint plant - is due to grow until September.

Speaking before the protest, St Albans District Council's executive leader, Julian Daly, said it had taken action to stop a demonstration on Rothamsted Research's land that "may put historic crop trials at risk".

"Continuous trials have been under way there for over 160 years and are of international significance for the future of world farming," he added.

Rothamsted has previously pleaded with anti-GM campaigners not to destroy their experimental plots.

The Lotus Lantern Parade

Order Korean Food From Amazon

Though Christianity has recently become the dominant religion in South Korea, the country had been a primarily Buddhist land for nearly all of its history. Buddha?s Birthday, which falls on May 28th this year, is a major celebration across the peninsula. And the week-long Lotus Lantern Festival which precedes it is an engaging reaffirmation of the country?s traditional faith.

The festival kicked off last Saturday with a host of events in Yongdusan Park, in Nampo-Dong. A collection of floats were on display ? automated dragons, Buddhas, fire-breathing peacocks ? and the park was packed with both monks and people out looking for a bit of fun. This wasn?t the most somber or conservative of religious festivals; one of the events was a B-Boy break-dancing competition.

A group of tents in the park constituted the Arts & Crafts center and, walking past, we were immediately targeted for participation by an overly-enthusiastic volunteer. She sat us down next to kids, where we created toy lanterns. Then she grabbed our arms and led us the ?ink stamping? section, where we pounded out Buddhist designs. Then she pushed us over to the ?wishing ribbon? section, where we wrote down our names and our dreams for the future. ?My name is Mike, and I wish for a world free from the scourge of Arts & Crafts!?

The festival-closing parade on Sunday night was a colorful event. We were surprised how few onlookers were lined up on Daechung Road to watch it pass, but then? most of the city was in the parade. Group after massive group of waving, lantern-carriers passed by, along with neon-colored float and the occasional marching band. We followed the final group up to Yongdusan Park, where there was a fireworks show followed by a concert of traditional drumming.

Insight: Iran's "Great Game" in Afghanistan

KABUL (Reuters) - With most foreign combat troops set to withdraw from Afghanistan by 2014, Iran is using the media in the war-ravaged nation to gain influence, a worrying issue for Washington.

Nearly a third of Afghanistan's media is backed by Iran, either financially or through providing content, Afghan officials and media groups say.

"What Iran wants, what they are striving at, is a power base in Afghanistan that can counter American influence," said a senior government official, who like others for this report, spoke to Reuters on condition of anonymity.

"They are without a doubt doing this through supporting and funding our media."

Iran spends $100 million a year in Afghanistan, much of it on the media, civil society projects and religious schools, says Daud Moradian, a former foreign ministry advisor who now teaches at the American University in Kabul.

"It is using Afghanistan to send a message to America that it can't be messed with. Afghanistan becomes a managed battlefield as a result."

Officials in Tehran could not be reached for comment despite repeated attempts and the Iranian embassy in Kabul said it was not prepared to talk about the issues raised in this report.

NEW STRATEGIC PACT

The landmark agreement NATO leaders sealed this week in Chicago, handing control of Afghanistan over to its own security forces by the middle of next year, puts the Western alliance on an "irreversible" path out of the unpopular, decade-long war.

Some security analysts say the withdrawal could lead to increasing instability and then to civil war -- and an opportunity for Iran and others to move into the resulting power vacuum.

When the Soviet Union withdrew from Afghanistan in 1989 following a decade-long occupation and the pro-Moscow government in Kabul collapsed, Afghanistan's neighbors moved in to arm and fund proxies to gain regional influence as the country plunged into civil war.

Although Kabul's ties with Tehran have seen sporadic improvement after the 2001 ouster of the Taliban, which had emerged triumphant after the civil war, the relationship is combustible.

The latest flashpoint is the recent signing of a long-term strategic agreement between the United States and Afghanistan. Though vague on details, the pact was meant to signal U.S. financial and security commitments to Afghanistan through 2024 - particularly for funding the large Afghan National Army.

Iran, whose frayed ties with the United States have worsened over its disputed nuclear programme, sees the pact as a threat. Iranian-backed media in Afghanistan responded by churning out reports critical of the agreement, and Tehran's ambassador to Afghanistan Abu Fazel Zohrawand threatened to expel Iran's one million Afghan refugees if the pact was not rejected.

IRAN'S TALKING HEADS

Afghanistan's intelligence department, the National Directorate of Security (NDS), had earlier gone public with Iran's alleged meddling in the media, saying that weekly newspaper Ensaf and TV channels Tamadon and Noor had received financial support from Iran.

A journalist who recently left Tamadon TV, owned by Afghanistan's most prominent Shi'ite cleric Ayatollah Mohammed Asef Mohseni, told Reuters that while the station never confirmed it was getting support from Tehran "it was obvious".

"My salary of $600 a month would fluctuate dramatically, as it was pegged to Iran's rial," said the 23-year-old, one of 200 employees at Tamadon, where he worked for four years before resigning over fears his employment would land him in trouble with Afghan authorities.

"Our office is full of posters calling for protests against the strategic pact with America. We'd invite pro-Iran analysts onto our shows saying Iran was the only one who could help Afghanistan with food and supplies," said the recent graduate, dressed in a tight black long-sleeved t-shirt and jeans.

Tamadon TV dismissed the claims of Iranian backing as an "insult". Editor in chief Mohammad Rahmati said the station was targeted "because we show core Islamic values; we don't show half-naked dancing women".

GREAT GAME

Afghanistan has been so much a focus of big power rivalry over the past 200 years -- a failed British occupation in the mid-19th century, the failed Russian one in the 1980s, for example -- it has its own historical sobriquet, "The Great Game".

As the United States prepares for its own dispirited withdrawal from Afghanistan, it is worried about Iran gaining a strategic advantage in Afghanistan, after seeing Tehran win influence in Iraq following the 2003 U.S. invasion.

More than half of the 171 TV, satellite channels and radio stations licensed to broadcast in Iraq today are funded by Iran, with others backed by the United States and Arabic Gulf countries, government communications officials say.

Iran's media strategy is but one strand in a multi-pronged projection of "soft power" into Afghanistan. The two countries share cultural, language and historical links -- for centuries they were part of the ancient Persian empire -- as well as a long and porous border.

Iran said in 2010 it has provided some $500 million in official assistance for reconstruction projects. Tehran has built religious schools for Afghan Shi'ites, who comprise a fifth of Sunni-majority Afghanistan's 30 million people.

Iran may even have MPs on its payroll. An Afghan official who declined to be identified told Reuters that up to 44 of the 249 members of the Afghan parliament are suspected of receiving money from Iran. Iran has not responded to those allegations, which have also been aired in the Afghan media.

SHI'ITE LINKS

Iran's vehement opposition to the new strategic pact with the United States appears to have intensified efforts to influence public opinion about it.

Ensaf newspaper, one of the three media outlets the government has said receives funding from Iran, and whose parent company Avapress has offices in Tehran, has published six critical articles on the pact since it was signed by President Barack Obama on a whistle-stop visit to Kabul on May 2.

The three media outlets feature news reports that hold little interest for Afghans, but are important to Iran, using the same messages and wordage carried by Iranian state media.

The state of Israel, for instance, is called "the Zionist regime", a term Afghan officials generally avoid using.

"The fact is the stories broadcast have been made available by Iranian sources for propaganda purposes", Loftullah Mashal, a spokesman for the intelligence agency NDS, said last month. The NDS later retracted that claim.

Iran first started attempting to influence Afghan affairs through the media in 2006, said Abdul Mujeeb Khalvatgar, executive director of the Afghan media development group Nai.

"The pace has been quickening since 2011, which is when Iran began to actually inject its viewpoint into Afghan media," he said.

Last year, Afghans were shocked when Tamadon TV broadcast a live speech by Iran's parliament speaker Ali Larijani criticizing the presence of Western troops in Afghanistan.

Kabul is countering with its own pressure.

The Kabul-based reporter of Iran's semi-official Fars News Agency, Abdul Hakimi, was arrested two weeks ago on charges of spying, Afghan officials said. The NDS declined to comment.

The relatively large, often Western-backed press corps can also face intimidation, abduction or even death for reporting on issues such as corruption and other government failings. Afghanistan ranks seventh on the Committee to Protect Journalists' "Impunity Index", a listing of countries where journalists are killed regularly and governments fail to solve the crimes.

One man who says he is painfully familiar with Iranian interference is author and journalist Razaq Mamoon. He says a masked man who threw acid in his face in January of last year was working for Tehran. The Iranian embassy in Kabul has not commented on his allegations.

Though media reports at the time said his assailant staged the attack over a soured love affair, Mamoon says his 2010 book which accuses Iran of sabotage and espionage in Afghanistan, motivated Iranian intelligence agencies to attack him.

"Those individuals who planned the attack on me are still in power and their Iranian spy agencies are still very active in Kabul," Mamoon, who now lives in New Delhi out of fear for his safety, told Reuters in e-mailed comments.

AAXA P3

With its 50-lumen rating, the LCOS-based AAXA P3 ($270 street) isn't the brightest pico projector available. The ?Optoma Pico PK320 Pocket Projector ($450 street, 3 stars), for one, claims 100 lumens. However, the P3 is bright for the price, and it offers any number of additional features that you might not expect at such a low cost, starting with an HDMI port and the ability to read files from a USB memory key. The combination makes it well worth considering.

One complicating factor is the 1,024 by 600 native resolution. This is better resolution than you'll find in most pico projectors, and generally counts as a plus. Both the PK320 and the Editors' Choice Optoma PK301 Pico Pocket Projector ($400 street, 4 stars), for example, offer WVGA (854 by 480). On the negative side, however, 1024 by 600 is unusual enough that most computers don't support it. If you set your computer to another widescreen resolution, like 854 by 480 or 1280 by 800, you'll introduce scaling artifacts caused by adding or dropping pixels to make the image match the projector's resolution.

Among other issues, the artifacts can make text harder to read. The alternative is to stay with standard SVGA (800 by 600), which will avoid the scaling artifacts and give you better image quality than with lower-resolution projectors, but that limits you to a 4:3 aspect ratio. As a practical matter, you may want to stay with 800 by 600 to get crisper data images and reserve the widescreen capability for video.

Basics, Setup, and Connections
As with any pico projector, one of the P3's key strengths is its portability. Measuring only 1.4 by 2.6 by 4.6 inches (HWD) and weighing 7.5 ounces, it's small and light enough for a shirt pocket. The power block adds 4 more ounces, but you can also run the P3 from its rechargeable battery, so you don't necessarily have to carry the power block on every trip. You'll probably want to bring it most of the time, however, since the claimed battery life is only 65 minutes.

Setup is mostly standard fare for a pico projector, with an assortment of adaptors to let you connect to a composite video source, a USB memory key (to read common image, audio and movie files), or a computer (using a VGA port). In addition AAXA also sells adaptors (at $12.99 to $19.99 direct each) for iPod, Zune, and PSP connections. The one connector worth special mention, because it's unusual for a pico projector, is a full-size HDMI port, for a computer or video source.

Brightness and Image Quality
The P3's 50-lumen rating is admittedly meager compared with most full-size projectors, but it's reasonably bright for a pico projector. As a practical matter, based on the SMPTE recommendations for brightness, 50 lumens is bright enough for a roughly 28- to 37-inch diagonal image at a 16:9 aspect ratio in theater-dark lighting.

One moderate issue is a problem maintaining uniform brightness across the entire screen. On the test unit, I saw vertical strips on both the extreme left and right sides that were noticeably dimmer than the rest of the screen. The issue showed only in screens with light color backgrounds, but is noticeable enough that some people might find it distracting.

Data image quality at 600 by 800 resolution was better than most pico projectors, with the P3 scoring relatively well on our standard suite of DisplayMate tests. Color balance was good, with suitably neutral grays over the entire range from black to white; colors were nicely saturated; and I saw only the slightest pixel jitter with an analog connection on screens that are designed to bring out jitter. Text was easy to read at sizes as small as 9 points.

Video quality was also good for a pico projector, with the P3 doing a reasonably good job in my tests of retaining shadow detail (details based on shading in dark areas) and resisting posterization (shading changing suddenly where it should change gradually.)

Also very much on the plus side is that the P3 shows far fewer rainbow artifacts?with bright areas breaking up into little red-green-blue rainbows?than most pico projectors. Even if you're sensitive to the effect, as I am, it's not likely that you'll see the artifacts often enough with either data or video images to find them annoying.

Other Issues
As is standard for pico projectors, the P3 uses LEDs for its light source. More important, the LEDs are meant to last the life of the projector, with a rated 15,000 hour lifetime, so you won't have to spend money on replacement lamps. As is also standard, the 1-watt speakers are hardly worth having. If you need sound, however, the audio out port lets you plug in a headset or external powered speaker.

It would be easier to give the P3 an enthusiastic recommendation if it offered a native resolution that was more widely supported. But even if you ignore the widescreen capability and treat it as astandard SVGA projector, there's still a lot to like. Its balance of small size, low weight, reasonable battery life, and good data and video image quality adds up to a strong argument for the P3. Factor in such niceties as the HDMI port plus the ability to read files from a USB key, and the combination makes the P3 a more than reasonable choice at an attractive price.

To Whom are the ACA "Positioners" Speaking?

Mark Tushnet raises, much better than I could, a question that has certainly been nagging at me these past few weeks if not months now. (He does so here?as well.)?What is the point of the countless online posts and articles from Jeffrey Rosen, Randy Barnett, Ilya Somin, several Balkinization posters, and so on that came after both the oral argument and the vote in the ACA litigation?

We might divide those posts into two categories.

The first consists of more or less substantive arguments about what the Court might or could say in an opinion. Some of them have been quite interesting. I'm frankly not sure what the point of any of them was. The tone of many of these posts, at least in my view, was neither highly partisan nor especially disinterested. They read at least a little as if the writers were trying to influence the Court's opinion(s), but that prospect seems unlikely, especially given the timing, although perhaps the writers hope to influence the course of a paragraph or two here and there. Really, though, they gave me a sense of bewildermant about audience. Of course one can write for oneself and perhaps that's what they're doing, and then one can write for the best reason of all -- money, or substitute goods -- and perhaps that's all that was going on; a writer's gotta write. But usually a conversation presupposes a recipient of the communication, and that seemed oddly ambiguous or lacking here.

The other set of posts have been thick on the ground lately: posts and articles about how a decision in this case will affect the legitimacy of the Court or the reputation of the justices, or how public opinion on the ACA will intersect with such a decision, and so on. Mark writes that "[t]he comments or predictions about the Court's reputation and the like are just that -- comments and predictions." That's true as far as it goes, but as he acknowledges, there's something more going on here: "Maybe it's softening the battlefield (by both sides) in anticipation of the Court's decisions, laying out the themes that both sides expect to use after the decisions come down. 'The Court's a captive of partisan Republicans"/"It's obnoxious [again, one of Parker's words] to criticize the Court for partisanship.'" There is, indeed, a sense that these comments are aimed at influencing something or someone, which after all is a primary purpose of communication in general.?But at what or whom??And is there anything unsavory about doing so, or is it perfectly "legitimate?"

The least cynical answer, I think, is that the discussants are talking to themselves and each other, for no other particular reason other than that that's what writers do. Blogs need to be filled; magazine articles and columns need to be filed; so why not write about what interests the writer or the audience. That's fine, I suppose, or at least commonplace (and one excellent reason not to get too invested in such discussions; there is nothing new under the sun and a new conversation will take its place tomorrow). But if that's all that's going on, the tone of those posts strikes me as odd. Questions of this sort are largely empirical and can be addressed without trying to influence the result or the course of the debate; but everyone writing writes as if they have a dog in the fight.?

Another possibility is that the commenters are trying to influence the justices or the clerks. This, I suppose, is what has given rise to all the talk of "intimidation" and so on. It has not escaped notice that if this is "intimidation," then many of the counter-posts also constitute intimidation. (Viz., Randy writing, in a post criticizing the "left" for threatening to "delegitimate" the Court, that "[t]here is no escaping the fact that the entire Affordable Care Act is deeply unpopular and any decision to uphold it will not be well received by the public.") I can't speak to the likelihood that such efforts would succeed. I hope they don't, on the whole. I don't think such efforts are wrong per se. If that's what's going on here, though, I would say that the reader who is neither a justice nor a law clerk is better off discounting strongly such posts given the evident partiality of the writers, and just ignoring the whole conversation, which has not been terribly useful or informative.

That leaves the possibility that Mark raises, which is that the writers are speaking primarily to opinion-makers and secondarily to the public: that all this is a matter of trying to set the terms of the discussion going forward, and particularly the political script for each side to follow. In such a scenario, the arguments made on either side may (and probably must) be plausible or even true, but their plausibility or truth is almost beside the point. The point is to determine in advance how the political conversation will run.

I'm not a total naif about this, but it still strikes me as troubling. For some of the individuals involved, there's a clear stake involved in this, either because they're political partisans or because any and every divisive issue is an opportunity for fund-raising, seeking solidarity goods, and so on. ("Armageddon is nigh; click here to give us money to fight against it.") For others, especially scholars engaged in such arguments, the best one can say, I think, is that they're taking a vacation from being scholars to write such posts, and that we're more than welcome to discount all their subsequent scholarship and blog posts as much as we see fit. (How you characterize Rosen is up to you, although it seems to me that by having more than one hat he ends up raising questions about all of them.)?

I suppose I can understand the desire to influence public opinion on political matters--although it seems to demonstrate a decidedly non-scholarly lack of a long timeline not to write with a sense that these scripts were all pre-written anyways and will be succeeded in time by equally predetermined scripts. As a scholar, though, I think our job is to witness and analyze such efforts in as disinterested a fashion as possible rather than to engage in them. I don't think politics is absent from law, nor that it should be. But I do think it's a constrained form of politics, and that engaging in a broader form of politics aimed at law is not a job for legal scholars. Perhaps I am a naif at that. ??

Comments

Since I wrote one of the Balkinization posts, although in my mind not one of the ones that you think are merely political positioning, I'll say a little about my motives.

My post came about because Jack had written his own post on the meaning of the taxing power. I e-mailed him to note that I thought that as a predictive matter, the taxing power route might be tempting for the court because it would allow them to say what they evidently want to say about commerce and still uphold the statute. He suggested I write up my e-mail as a post; I did.

This was the electronic equivalent of lunch-table conversation. Punditry pro causa punditry. We're professors; we think about stuff; we tell others what we're thinking. Sometimes this process is useful, sometimes it's pointless. My view, and I think yours too, is that it isn't possible to separate the two until long after the words are said or written.

Having said that, I would also happily defend the position that academics are entitled to, and even sometimes should, say things to influence political conversation. There are some in our profession who will take advantage of the rational ignorance of the public to describe arguments as legitimate that are not. (Others may even sincerely believe that judges will inevitably reject long-standing law in favor of their own fringe view; I guess because Hercules/the fringe academic believes his/her view so strongly that s/he cannot see how anyone could persist in disagreement. Probably we should all be open to the possibility we're one of those people.)

Anyway, my point is that I see our profession as having an obligation to the public to offer informed criticism of the work of public officials. By its nature this criticism is aimed at informing and shaping political conversation. Some of it may be defended as "better" -- describing our sincere intellectual position is more true to the scholarly mission (as I see it) than taking positions we don't believe in order to increase the political power of those we otherwise sympathize with. But I don't see the whole project as illegitimate.

Maybe it was just your effort to be diplomatically elliptical, but your post comes off as criticizing all of the commentators alike. As I said, I see distinctions (although of course the sincerity of someone's arguments is hard for those of us outside their head to judge). Don't you?

More details will come when Samsung releases its full quarterly results.

April 12: Google Inc. reports adjusted earnings and adjusted revenue that beat expectations. Google's revenue was helped by a 39 percent increase in "paid clicks," but the prices of its search-driven text ads continued to decline. CEO Larry Page called the first quarter "very strong," but acknowledged there's more work to do.

April 17: Yahoo Inc.'s first-quarter earnings show signs of modest progress under recently hired CEO Scott Thompson. Net income grew 28 percent from the same time last year and exceeded expectations. Revenue grew less than 1 percent, but represented a breakthrough because the company's revenue has been steadily falling for years.

IBM Corp. says first-quarter net income grew 7 percent, helped by strong profit margins in its services business and strong revenue growth across its software and services businesses. Revenue was flat overall because of declines in the hardware and financing segments, and revenue fell short of analysts' expectations. IBM increases its full-year guidance to at least $15 per share, above the $14.93 expected by analysts.

Intel Corp. says its net income in the first quarter fell 13 percent as spending on research and marketing rose while sales were flat.

April 18: EBay Inc. says its first-quarter net income grew 20 percent thanks to higher revenue from its PayPal business and brisk sales at its e-commerce websites. The results beat Wall Street's expectations.

Mobile phone chipmaker Qualcomm Inc. says its quarterly profit more than doubled as strong demand for smartphones boosted its sales; but it expects costs to increase as it makes more chips.

April 19: Microsoft Corp. fares better than analysts anticipated in its latest quarter, boosted by a surprising rise in sales of its Windows operating system for personal computers

Chipmaker Advanced Micro Devices Inc. reports adjusted earnings and revenue that beat Wall Street's expectations. AMD's revenue forecast for the current quarter was at $1.59 billion to $1.68 billion, while analysts surveyed by FactSet were expecting $1.59 billion.

Nokia Corp. reports a huge net loss, one of the company's worst ever quarters, and blames tougher-than-expected competition. It has faced stiff competition from the likes of Apple Inc.'s iPhone and handset makers using Google Inc.'s popular Android software.

April 23: Netflix Inc. says it suffered its first quarterly loss in seven years, but the setback was far smaller than analysts expected. Netflix had rising licensing fees and a bill for an international expansion. Netflix predicted that it would make money during the current quarter. Still, Wall Street was worried about tougher competition. Skittish investors keyed on a second-quarter forecast that calls for a slowdown in subscriber growth during the spring and early summer.

Chipmaker Texas Instruments Inc. says first-quarter net income fell 60 percent from a year ago as revenue shrank. But the results still beat analysts' expectations.

Xerox Corp. says first-quarter net income fell 4 percent as the company spent more on building its services business, which now makes up more than half the company's revenue. The company says it's investing in new offerings and long-term contracts in order to increase growth. In the short term, that has hurt profitability.

April 24: Apple Inc. reported blowout iPhone sales ? 35 million in the latest quarter, almost twice as many as it sold a year ago and above analyst expectations. Net income nearly doubled to $11.6 billion, and revenue was up 59 percent at $39.2 billion. IPad sales came in below analyst expectations, at 11.8 million units. But that was still two and a half times as many as it sold in the same quarter a year ago.

April 25: Motorola Solutions Inc., which sells communications equipment to government and corporate customers, says first-quarter net income declined from a year ago, when the company recorded a large tax-related gain. Revenue grew thanks to strong demand from the company's government customers.

April 26: Amazon.com Inc. reports strong quarterly earnings and says its Kindle Fire tablet computer remains its best-selling item. However, its outlook for revenue growth was slower than expected.

Online games company Zynga Inc. reports adjusted earnings of 6 cents a share, a penny better than what Wall Street expected. Revenue grew 32 percent.

April 27: A surge in Galaxy smartphone sales fueled earnings at Samsung Electronics to a record high in the first quarter, usually a tough season for the global consumer-electronics industry. The South Korean company outshined handset rivals such as Nokia Corp. Strong demand for high-end smartphones, such as the Galaxy Note and the Galaxy S2 introduced last year, helped mask lower profit from memory chips, another Samsung flagship business.

May 1: Mobile phone maker Motorola Mobility Holdings Inc. reports a slightly larger net loss in the first quarter as expenses grew more than revenue. Motorola says it still expects its acquisition by Google to close by the end of June. The deal still needs to be approved by authorities in China.

May 3: LinkedIn Corp. says its first-quarter net income more than doubled, and its revenue doubled from a year ago. Adjusted profit and revenue beat expectations. During the quarter, revenue grew across the company's divisions. The business-networking company also announces plans to buy presentation-sharing website SlideShare for $118.8 million.

May 9: Cisco Systems Inc. says its quarterly earnings surged 20 percent in the latest sign that a recently completed overhaul is paying off for the world's largest maker of computer-networking equipment. However, Cisco raised the specter of a sharp slowdown in technology spending, rattling investors already fretting about the economy's fragile condition. Cisco made a sobering forecast for the current quarter and traced it to skittish customers who are waiting longer to close deals and spending less money because of growing uncertainty about the economy, particularly in Europe and India.

May 14: Online deals company Groupon Inc. says it had a smaller net loss and sharply higher revenue in the first quarter, helped by increased demand from a growing customer base.

May 17: Salesforce.com Inc., which makes Web-based business software, says it had a net loss in the first quarter, but adjusted profit and revenue beat expectations. It raises its forecast for full-year results.

Tuesday: Dell Inc. reports disappointing first-quarter results and forecasts weak sales in the current quarter. The computer maker says sales to big businesses, consumers and the public sector decreased.

Wednesday: Hewlett-Packard Co. says it will cut 27,000 workers, or 8 percent of its work force, by October 2014. News of the cutbacks overshadowed the release of HP's latest quarterly results. The company's earnings and revenue were both better than analysts projected.

Coming up:

June 19: Adobe Systems Inc.

June 28: Research in Motion Ltd.

Not yet known: Oracle Corp. (June).
